Terms of Service

1. Agreement to Terms

By accessing or using the totes into you storefront (totesintoyou.com), our profile hosting service (intoyou.me), purchasing our products, or using any of our services (collectively, the “Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Service.

The Service is operated by Totes Into You LLC, a North Carolina limited liability company (“totes into you,” “we,” “us,” or “our”). For questions, contact us at legal@totesintoyou.com.

2. Eligibility

You must be at least 13 years of age to use the Service. If you are between 13 and 18, you may only use the Service with the consent and supervision of a parent or legal guardian who agrees to be bound by these Terms on your behalf.

By using the Service, you represent that you meet these age requirements. We do not knowingly collect personal information from children under 13 without verifiable parental consent, in accordance with the Children’s Online Privacy Protection Act (COPPA).

3. Description of Service

totes into you sells personalized tote bags printed with a QR code. Each QR code directs scanners to a destination chosen by the buyer, which may be:

A direct URL (Instagram, WhatsApp, custom link)
A hosted profile page on intoyou.me

Profile pages allow buyers to display personal information (bio, photo, social links) and receive messages from people who scan their QR code.

4. Accounts and Profile Pages

Profile pages are created and managed via a magic link sent to the email address provided at purchase. You are responsible for maintaining the security of your magic link and the accuracy of your profile content.

You may update the destination URL associated with your QR code at any time through the profile management interface.

Profile pages remain active for two (2) years from the date of purchase. We will send reminder notifications by email before expiry. You may extend your profile for an additional two-year term for $9 USD (or the equivalent in EUR or GBP at checkout). Extension is optional; if you do not extend, your profile page will be deactivated, although your QR code may still be repointed to a direct URL such as a social media profile.

5. Purchases, Payments, and Refunds

All purchases are processed through Shopify. Prices are listed in USD. Payment terms and processing are governed by Shopify’s terms of service.

Because each tote bag is a custom-printed product made to your specifications, all sales are final. We do not accept returns or exchanges unless the product arrives damaged or defective. For the full return and refund policy, please see the policy listed on our Shopify store.

6. Prohibited Content

You agree not to use your profile page or any part of the Service to host, display, distribute, or link to content that:

Is sexually explicit or pornographic
Promotes hatred, violence, discrimination, or harassment against any individual or group
Is illegal or facilitates illegal activity
Infringes on the intellectual property rights of others
Contains malware, phishing links, or other harmful code
Impersonates another person or entity
Is spam, fraudulent, or misleading

We reserve the right to review profile content and to remove or disable any profile that violates these Terms, at our sole discretion and without prior notice.

7. Termination and Suspension

We may suspend or terminate your access to the Service, including disabling your profile page and QR code redirect, if we reasonably believe you have violated these Terms. We will attempt to notify you by email, but are not required to do so.

Profile pages that are not extended after their two-year term will be deactivated. Data associated with inactive profiles is deleted six (6) months after deactivation. See Section 4 for details on the profile term and extension fee.

8. Messaging Feature

The Service includes a messaging feature that allows people who scan your QR code to send you a message along with their contact information (email, phone number, or social profile). By using a profile page, you consent to receiving messages from third parties via this feature.

totes into you is not responsible for the content of messages sent through this feature. We do not monitor or moderate messages. You are responsible for any interactions that result from messages received.

9. Intellectual Property

All content, branding, design, and code associated with the Service (excluding user-generated content on profile pages) is the property of totes into you and is protected by applicable intellectual property laws.

You retain ownership of any content you upload to your profile page. By uploading content, you grant totes into you a non-exclusive, worldwide, royalty-free license to host, display, and distribute that content solely for the purpose of operating the Service.

10. Limitation of Liability

To the maximum extent permitted by law, totes into you’s total liability to you for any claim arising out of or relating to the Service shall not exceed the amount you paid for the specific product or service giving rise to the claim.

totes into you is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, regardless of whether we have been advised of the possibility of such damages.

We do not guarantee that the Service (including QR code redirects and profile pages) will be available at all times, uninterrupted, or error-free.

11. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Indemnification

You agree to indemnify and hold harmless totes into you, its owners, and its affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your profile content, or your violation of these Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of North Carolina, without regard to its conflict of laws principles. Any disputes arising from these Terms or the Service shall be resolved in a court of competent jurisdiction located in North Carolina.

14. International Users

The Service is operated from and intended for use in the United States. If you access the Service from outside the United States, you do so at your own risk and are responsible for compliance with local laws. By using the Service, you consent to the transfer and processing of your data in the United States.

15. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or by posting a notice on the Service. Your continued use of the Service after changes take effect constitutes your acceptance of the revised Terms.
